May 17, 1954: The Supreme Court Rules on Brown v. Board of Education

On this day in 1954, the U.S. Supreme Court ruled unanimously that racial segregation in public schools violated the Fourteenth Amendment to the Constitution, which says that no state may deny equal protection of the laws to any person within its jurisdiction.

Although the decision did not succeed in fully desegregating public education in the United States, it put the Constitution on the side of racial equality and galvanized the nascent civil rights movement into a full revolution.

The Justice Department has acknowledged seizing the work, home and cellphone records used by almost 100 reporters and editors at the Associated Press. The phones targeted included the general AP office numbers in New York City, Washington, D.C., and Hartford, Connecticut, and the main number for the AP in the House of Representatives press gallery. The action likely came as part of a probe into the leaks behind an AP story on the U.S. intelligence operation that stopped a Yemen-based al-Qaeda bombing plot on a U.S.-bound airplane. Hedges, a senior fellow at The Nation Institute and former New York Times reporter, calls the monitoring “one more assault in a long series of assaults against freedom of information and freedom of the press.” Highlighting the Obama administration’s targeting of government whistleblowers, Hedges adds: “Talk to any investigative journalist who must investigate the government and they will tell you that there is a deep freeze. People are terrified of speaking, because they are terrified of going to jail.”

Outraged against austerity, students & teachers in Philadelphia resist the machine of capitalism
May 17, 2013

Dozens to hundreds of Philadelphia students, teachers and school staff protested outside one of the city’s premiere high schools in an effort to fight proposed budget cuts to the district.

Wearing signs and handing out pamphlets to drivers, members of the Philadelphia Federation of Teachers lined the sidewalk outside the Philadelphia High School for the Creative and Performing Arts along South Broad Street Friday morning. The teachers are fighting a series of severe budget cuts proposed by the district to close a more than $300 million funding gap. The proposed cuts include ending arts and music programs, sports and cutting auxiliary staff like secretaries, librarians and counselors.

“With the austere budgets schools have received, schools will not be able to provide a high-quality education for Philadelphia’s children,” said Jerry Jordan, president of the Philadelphia Federation of Teachers. Jordan says the teacher’s union has been discussing labor concessions with the district. However, he says a concession that results teachers taking a pay cut is a non-starter.

“The school district is asking for salary cuts for all PFT members of anywhere between 5, 10 and 13-percent,” he said. “I don’t think that you’ll find employee in the school district and the PFT…who are going to tell you that they can afford to take that kind of pay cut.”

The teacher protest is just the first of many demonstrations planned Friday over the funding flap.

Students from Philadelphia public schools around the city have also walked out of class and are marching on the School District of Philadelphia and Philadelphia City Hall. Similar walkouts were organized last week by students, who also marched on the same spots.

District spokesman Fernando Gallard says staff will not stop students from walking out, but says officials have asked principals remind students that leaving early will results in being marked as cutting. “Schools will follow the district’s attendance policy and will take the appropriate action which triggers at least a phone call to parents to notify them of the student’s absence, a request for a parent conference at the school, or after school detention,” he said.

Students are using Twitter to organize and document their protests. The group Philly Student Union is promoting the hashtag #walkout215 as a digital rally point during the event.

Goodale is a leading legal expert on the First Amendment and has just published a new book, “Fighting for the Press: The Inside Story of the Pentagon Papers and Other Battles.”

JAMES GOODALE: After the Pentagon Papers ended, which was a case about censorship, Mitchell, who was Nixon’s attorney general, got very excited about prosecuting The New York Times. People have forgotten about that. So he convened a grand jury in Boston, because there was some evidence that the Pentagon Papers had been circulated in the antiwar community before they were published by The New York Times. And the theory was that the New York Times reporter conspired with those antiwar protesters, and he was going to indict them for conspiracy.

So, now, fast-forward. What is Obama doing? He’s convened a grand jury. We haven’t heard about it; I think it’s still there. I think it may have even indicted Assange in secrecy. But what’s the charge? Conspiracy. Well, we don’t expect our listeners to be lawyers and jump up and down when they hear the word “conspiracy.” I just want to tell you in the audience, it’s very easy to prove conspiracy, very hard to prove espionage under the Espionage Act. So what Obama is doing is doing an end run and trying to get an easy case against Assange, after he’s convicted Manning. It’s easy to convict Manning, OK? So that easy conviction then becomes the basis for the agreement for Assange.

So, my book is meant to be a clarion call to the journalist community: Wake up! There’s danger out there. You may not like Assange, but wake up! The First Amendment is really going to be damaged, if Obama goes forward. And as I said at the beginning of the show, if he does and succeeds, he will have succeeded where Nixon failed.

Fed up with Abercrombie & Fitch’s douchey elitist policies - no clothes for the chubby or otherwise unbeautiful people, thanks - an L.A. filmmaker has begun a campaign to rebrand A&F clothes by giving them away to the people he knows A&F doesn’t want wearing them - the homeless. Greg Karber is particularly incensed at A&F’s admission that they burn surplus clothes rather than give them away. His video doing so has sparked both the indignant charge that he’s exploiting the homeless by using them as props, and righteous admiration. There’s also a Change.org petition insisting it’s time for the company to “embrace the beauty in all sizes.”

Except that the people that did this are long dead, and by saying statements like ^ this, you’re only perpetuating the hate. Maybe white people now are just interested in the culture? I know I am. I married a Latin man, and when his Guatemalan family sees me trying to learn Spanish and wearing huipiles, they sure as hell aren’t thinking how “my people” have been repressing them for generations, or that I’m trying to steal their culture from them. They’re just grateful for someone who is genuinely trying to understand their culture, skin color be damned.

All “white people” are not the same. There are good and bad people of EVERY color.

Stealing, stereotyping, appropriating, patronizing, us & our customs is not just “interest”. It is false entitlement, theft, sacrilege, offense, mockery, dangerous obsession, racism, harassment, and so forth.

“Interest” isn’t always actively stealing or destroying something you like. There are those who kill animals/flowers/etc just to add to a collection (to own them?), and there are those who let them be WITHOUT destroying them/killing/stealing aka BEING SELFISH.

Which are you trying to do to us?

If I am interested in the art, purple heart/war medals, religious certifications, whatever you or your family EARNED or made, I can’t just steal them or legally counterfeit them.

You cannot choose to be Native American, no matter what you do/try, the amount of huipiles you wear, or what some random family who doesn’t speak for everyone says. You/they are not an island or in a secluded bubble.

Are some people so ashamed of what their own culture includes that they feel the need to try to take someone else’s, & if so, isn’t that just keeping the cycle going?

Harper government withheld documents in indigenous human-rights case:

The Harper government withheld tens of thousands of documents that it was obligated to disclose as part of a human-rights case in which it is accused of discriminating against indigenous children. Now, it is using its failure to hand over the files to try to get the proceedings put on hold.

The First Nations Child and Family Caring Society filed a complaint with the Canadian Human Rights Tribunal in 2007 saying it is wrong for the federal government to pay 22 per cent less for child welfare on reserves than the provinces pay for non-aboriginal welfare services.

Despite many attempts by the government to have the case dismissed, the hearings before the tribunal finally began in February of this year.

But, next Tuesday, Justice Department lawyers will ask for an adjournment of many months while they gather more than 50,000 documents that were required to have already been handed over to the Caring Society’s lawyers under the human-rights commission rules.

Hey so when the federal government got caught illegally hiding 50,000 documents which it was required to turn over for what could potentially be a very large and expensive human rights case, they responded by insisting that they needed the whole proceeding adjourned for months while they collected all those documents.

That’s it. That’s exactly what happened. That’s just how things are now.

Overcrowding and poor living conditions in Iraq’s Domeez camp have led to a recent deterioration in the health of Syrian refugees. Stéphane Reynier, emergency coordinator for MSF, describes the current situation in the camp:

The day we arrived in Athens, we approached a man as we walked through Exarcheia, a district that’s traditionally been home to anarchists and is now known for its high concentration of addicts. The man was glaring at the sky, shouting. I thought he was screaming at God, but it turned out he was just yelling about a broken traffic light. Cars swept past, their drivers giving him no opportunity to beg at their windows. He was inconsolable, flitting between rage and tears, but after I bought him an orange juice, he chilled out, said his name was Konstantinos and told me all about sisa.

“The cocaine of the poor! It’s the cocaine of the poor!” he shouted. He said that people he knew who smoked too much were losing limbs. “If you smoke it for six months, you’ll be dead,” he said. He claimed that he wasn’t a user, but the next day I bumped into him again and he beckoned for me to follow, squatted behind a car and smoked a pipe full of sisa. It was the middle of the afternoon.

[…] I asked him why he thought local police officers were behind the distribution of the potentially fatal narcotic. “Some of [the users] came to us and said that the police told them to go to Exarcheia. They said, ‘We cannot do it anywhere else, they send us away from all the other territories, all the other squares. They said go to Exarcheia.’”

“So you believe it’s political?” I asked.

“Yeah, this whole social movement is starting to rise up, and they want to have an excuse to come in as a savior for the residents… They’ve done it before, like two decades ago with heroin.”
